Terms of Service

KunosF&B is a cloud-based food and beverage business management platform operated by Kode Digital Sdn Bhd (202201015405 (1461102-X)). By creating an account and using KunosF&B, you agree to the terms set out in this document.

KunosF&B operates on a subscription basis. Access to the platform requires an active, paid subscription.

• Subscription fees are billed on a recurring cycle
• Payment is due by the invoice due date stated on each billing cycle
• If payment is not received by the due date, your account access will be suspended immediately until the outstanding balance is settled
• Kode Digital reserves the right to permanently terminate accounts with extended non-payment

We will provide invoice notices in advance of each due date. It is your responsibility to ensure payment is made on time to avoid disruption to your operations.

When you register for a KunosF&B account, you are responsible for:

• Keeping your login credentials (username, password, and any access keys) secure and confidential
• All activity that occurs under your account
• Notifying Kode Digital immediately if you suspect unauthorised access to your account

Kode Digital will not be held liable for any loss or damage arising from your failure to keep your login details secure. Do not share your account credentials with unauthorised parties.

KunosF&B is a fully hosted service. All data entered into the platform, including business records, transaction data, menu configurations, staff records, customer information, and more, are stored on servers managed by Kode Digital Sdn Bhd.

By using KunosF&B, you acknowledge and agree that:

• Your data resides on Kode Digital’s infrastructure for the duration of your subscription
• Kode Digital will take reasonable measures to keep your data secure
• Upon termination or cancellation of your subscription, you should export any data you require before your access is removed. Kode Digital is not obligated to retain your data after account termination

We aim to keep KunosF&B available at all times, but we do not guarantee uninterrupted access. From time to time, the platform may be taken offline for:

• Scheduled maintenance - We will notify users in advance where possible
• Unscheduled maintenance or emergency fixes - May occur without prior notice
• Infrastructure upgrades - Carried out to improve platform performance and stability

Kode Digital will not be held liable for any business disruption, loss of revenue, or data loss arising from scheduled or unscheduled downtime.

Kode Digital reserves the right to modify, add, or remove features from KunosF&B at any time. Changes may be made to:

• Improve usability and system performance
• Respond to regulatory or compliance requirements
• Reflect changes in technology or business needs

Where a change significantly affects how the platform works, we will endeavour to inform subscribers in advance. Continued use of the platform after a change has been made constitutes your acceptance of the updated version.

You agree to use KunosF&B only for lawful business purposes. You must not:

• Use the platform to store or process illegal content
• Attempt to access, reverse-engineer, or interfere with the platform’s underlying systems
• Share your account access with competitors or third parties without Kode Digital’s written consent
• Use the platform in any way that could damage, disable, or impair its operation

Either party may terminate the subscription with written notice. Kode Digital reserves the right to terminate your account immediately and without notice if:

• You breach any term in this agreement
• Payment remains outstanding beyond a reasonable period after suspension
• Your use of the platform is found to be unlawful or harmful

To the fullest extent permitted by Malaysian law, Kode Digital shall not be liable for any indirect, incidental, or consequential loss arising from your use of KunosF&B, including but not limited to loss of data, loss of revenue, or business interruption.

These Terms of Service are governed by the laws of Malaysia. Any disputes arising from this agreement shall be subject to the jurisdiction of the courts of Malaysia.
